§ 10.3. Amendment procedure.

  • 10.3.1.

    Petition to town council. Each petition by one or more owners for an amendment shall be submitted in application to the town clerk on a standard form provided. A fee shall be paid at the time of application to cover costs of necessary advertisement for public hearing, administrative cost and investigation of amendment request. No part of the fee shall be returned to the petitioner. The town clerk shall transmit the application to the town council at its next regularly scheduled workshop meeting for consideration of placing it on the agenda at its next meeting where legal advertisement requirements will have been met. The council chairman may request a special meeting to hear the petition, if concurrence of the majority of the council members is given.

    10.3.2.

    Planning and zoning board review. The town council shall refer every proposed amendment, supplement, or change to the planning and zoning board for review and recommendation. The planning and zoning board may hold meetings if they feel it is necessary to fully explain the proposed revisions to the general public.

    10.3.3.

    Public hearing. After deliberation on the proposal, the planning and zoning board shall hold as many public hearings as are required by statutes. If the town council is in fact sitting as the planning and zoning board, then a combined meeting may be held with the announced attention that council is the planning and zoning board. The first portion of the meeting shall have the recommendatory body; after adjournment, the meeting can be then held with the town council sitting as a legislative body.

    10.3.5.

    Resubmittals. No application for ordinance text change or zoning map change which has been denied by the town council shall be resubmitted for a period of one year from the date of the last denial. However, whenever there are grounds of newly discovered evidence or proof of changed conditions found upon inspection by the town council to be valid, a resubmittal may be made after six months upon favorable approval of a majority of council members.
