§ 2-79. Limitation for service by town attorney.

  • The town attorney or his designee shall be either counsel to the code enforcement board or shall represent the town by presenting cases before the code enforcement board. In no case shall the town attorney serve in both capacities. Counsel to the code enforcement board shall attend all meetings of the board, and shall assist the board in the conduct of its hearings and in the performance of its duties. In the event the town attorney acts as counsel to the code enforcement board, an attorney may be appointed by the town council to present all cases before the board. In the event the town attorney presents cases before the board, an attorney appointed by the town council shall act as counsel to the code enforcement board.
