§ 8-46. Unfit or unsafe dwellings or structures.

  • Under this article and under other applicable ordinances of the town, including the ordinances applicable to dangerous buildings and fire and health codes, any dwelling or structure which shall be found to have any of the following defects shall be designated as an unfit or unsafe building and a nuisance and shall be abated by repair and rehabilitation or by demolition in accordance to procedures prescribed by this article:

    (1)

    Any building which by reason of fire, age, decay, deterioration, structural defects, improper design, unstable foundation, termites, acts of God or other causes shall be dangerous to the occupants thereof, a menace to public health, a fire hazard, or so unsafe as to endanger life to property or render the use of public streets dangerous;

    (2)

    Any building which lacks illumination, ventilation or sanitation facilities adequate to protect the health and safety of the occupants or to the public;

    (3)

    Any building because of its general condition or location is unsanitary or otherwise dangerous to the health or safety of the occupants or to the public;

    (4)

    Any building where the owner or occupant has failed to comply with a notice from the enforcing official issued and served in accordance with section 8-48 and the time allowed therein within which to request a hearing before the building board of adjustment and appeals has expired;

    (5)

    Any building which contains violations of this Code which the building official determines shall cost more than 50 percent of the value of the dwelling or structure as described in section 8-49; or

    (6)

    Any building not completed in substantial conformity with plans and specifications upon which the building permit for construction was issued where 120 days or more have lapsed since the expiration, revocation or cancellation of the building permit authorizing same, which is unsafe, unsanitary or constitutes a fire hazard or is otherwise dangerous to human health or which in relation to existing uses, constitutes a hazard to safety and health by reason of abandonment.
